A note before you readThese terms are a practical launch version for the current Pezani service. They are provided by Musafari Life, a registered business in Malawi operating from Kachere Street 3, Area 49/1, Lilongwe. Country-specific consumer, privacy and business obligations should still receive qualified legal review before a wider commercial launch.
1. Agreement and service scope
By visiting pezani.app, downloading or testing the Pezani app, creating an account, or using a Pezani feature, you agree to these Terms of Use and our Privacy Policy. If you do not agree, do not use the service.
Pezani is a local discovery service and a product of Musafari Life. It may include the website, Android app, iOS TestFlight build, search and category browsing, business profiles, deals, events, saved places, Quick Finder requests, messages and tools for businesses. Features can differ by country, platform or release while we build the service.
2. Eligibility
You must be at least 13 years old to use Pezani, or older if the law where you live requires it. If you use Pezani for a business, organisation or other person, you confirm that you have authority to accept these terms for them. You are responsible for following the laws that apply to you, including rules about advertising, consumer protection, data protection and permits.
3. Accounts and access
Some features require an account. Give us information that is accurate and keep it up to date. Protect your password, verification codes and device; activity from your account may be treated as activity you authorised unless you tell us promptly that it was compromised.
We may ask you to verify an email address, phone number or business detail to protect the community. We may limit, suspend or close access where we reasonably believe an account is unsafe, deceptive, unlawful or being used in breach of these terms. 4. Discovery, listings and Quick Finder
Pezani helps you discover businesses, services, places, deals and events using information supplied by businesses, users and service providers. A listing is not a guarantee that a business is licensed, available, safe, affordable, open, nearby or suitable for your particular need. Check important details directly before relying on them.
When you use Quick Finder, you describe what you need, choose a location and category, and may add a budget or photos. Pezani may route those details to relevant businesses so they can decide whether to respond. You control what you submit; do not include passwords, one-time codes, full payment credentials or sensitive information that a business does not need.
A request is not an order, booking, quote or contract. Pezani does not promise that a business will respond, that a response will be accurate, or that a transaction will happen. Any agreement, price, delivery, appointment or payment is between you and the business.
5. Content you submit
You keep ownership of content you submit, including text, photos, logos, business details, reviews and messages. You give Pezani a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, format, translate, display and transmit that content only as needed to operate, improve, secure and promote the service. This licence ends for content when it is deleted, except where it must remain in backups, records, disputes or legal compliance.
You promise that you own or have permission to submit the content, that it is not misleading, and that it does not violate another person's rights or the law. Do not publish private information about another person without a lawful reason and permission. You are responsible for your content and for responding to people who rely on information you publish.
If you report content, we may review it and take action under these terms or applicable law. We do not have to publish, keep or restore every submission.
6. Business and professional listings
If you create or manage a business profile, you must provide an accurate name, location or service area, contact route, category, hours, pricing and availability. Keep listings, offers and events current, honour commitments you make, and obtain the permissions, licences and consents required for your business and marketing.
Do not create duplicate, fake or impersonating profiles, use another business's branding without permission, manipulate rankings or reviews, or use Pezani to send unsolicited messages. Pezani may label, edit, refuse, remove or limit a listing when needed to keep discovery useful and trustworthy.
7. Acceptable use
Use Pezani respectfully and only for lawful purposes. You must not:
- harass, threaten, discriminate against, defraud or impersonate another person or business;
- submit malware, harmful code, unlawful material or content that infringes intellectual-property, privacy or publicity rights;
- scrape, crawl, mirror, reverse engineer, overload or interfere with the service or its security controls;
- send spam, fake requests, fake reviews, pyramid schemes, prohibited goods or misleading offers;
- collect or export contact information or messages for a purpose the person did not expect; or
- use Pezani for emergencies, medical diagnosis, law-enforcement dispatch or any situation where delay could cause harm.
We may investigate suspected misuse and preserve or share information where reasonably necessary to protect people, the service or our legal rights.
8. Conversations, transactions and safety
Pezani is a place to start a useful local conversation, not a party to your dealings with a business. Verify identity, quality, availability, total cost, delivery arrangements and payment instructions yourself. Meet in a safe place, be cautious with advance payments and report suspicious behaviour. Do not treat a Pezani listing, badge or response as an endorsement or guarantee.
Messages and attachments may be visible to the people or businesses you choose to contact. Never send a password, verification code, full card number or other secret through a request or chat. For urgent danger or an emergency, contact the relevant local emergency service.
9. App stores and third-party services
Android downloads, Apple TestFlight and future app-store releases are also subject to the rules of the relevant store or testing programme. Maps, email, hosting, payments, messaging and other linked services may have separate terms and privacy notices. Pezani is not responsible for third-party services that it does not control, including their availability, content, security or decisions.
10. Pezani's rights
The Pezani name, logo, visual system, software, site design, text and original graphics are owned by Pezani or its licensors. We grant you a limited, revocable, non-transferable right to use the service for its intended purpose. Except for content you own or have permission to use, do not copy, sell, frame, modify or commercially exploit Pezani without written permission.
If you send suggestions or feedback, you allow Pezani to use them without restriction or payment, while keeping any rights you already have in the underlying idea or content.
11. Availability and disclaimers
To the extent permitted by law, Pezani is provided on an “as available” basis. We work to keep it useful and secure, but we do not promise uninterrupted access, error-free operation, complete or current listings, successful matching, business responses, a particular result or that every feature will be available in every country.
Information supplied by businesses and users belongs to them. Pezani does not independently verify every claim and is not the seller, provider, agent, insurer or payment intermediary for a business you discover. Mandatory consumer, privacy or other rights that cannot lawfully be excluded remain unaffected.
12. Liability and indemnity
To the extent permitted by law, Pezani and its people will not be liable for indirect, incidental, special or consequential loss, lost profits, lost data, missed opportunities, property damage or harm arising from your dealings with another user or business, your inability to use the service, or content supplied by someone else. Nothing in these terms excludes liability that cannot be excluded by law.
Where permitted, you agree to reimburse Pezani for reasonable losses, claims and costs arising from your unlawful use, your breach of these terms or content you submit. This does not require you to indemnify Pezani for its own unlawful conduct.
13. Suspension, termination and changes
You can stop using Pezani at any time. We may change, pause or discontinue a feature, or suspend or terminate access, where reasonably needed for safety, maintenance, legal compliance or a breach of these terms. Provisions about content rights, payment obligations, disclaimers, liability, indemnity and disputes continue where their purpose requires it.
We may update these terms as Pezani develops. The effective date above will change with a revision. If a change materially affects your use, we will take reasonable steps to highlight it. Continuing to use Pezani after the effective date means you accept the updated terms.
14. Governing law and disputes
Unless mandatory local law requires otherwise, these terms are governed by the laws of the place where Pezani's operating entity is registered, and disputes will be handled by the courts with jurisdiction there. If consumer or other mandatory law gives you a different forum or protection, that law applies to the extent required. We are happy to hear from you first so we can try to resolve a concern informally.
